Intellectual property

All content on the Service, including but not limited to images, text, logos, documents, and downloadable files, is owned by or licensed to Decy Technologies Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Acceptable use

You agree not to use the Service in any way that:

• Violates any intellectual property rights
• Involves unauthorized access to other accounts
• Constitutes fraudulent activity
• Scrapes or bulk-exports our stretch databases
• Shares premium account credentials with others
• Uses automated bots or scripts to simulate stretching activity
• Exploits the subscription credit system in ways not intended by the Service

Account responsibilities

You are solely responsible for:

• Maintaining the security and privacy of your account credentials
• Keeping your personal information accurate and up to date
• All activity that occurs under your account

Custom routines you create in the app are stored locally on your device and are not backed up to our servers. We are not responsible for loss of locally stored data.

We reserve the right to suspend or terminate your account for illegal use or violation of these Terms.

Goods and services

Subscriptions

Subscriptions renew automatically on a monthly basis and are billed until cancelled. To avoid being charged for the next billing period, you must cancel at least 24 hours before your next renewal date through your Apple App Store or Google Play account settings.

After cancellation, you retain full access to the Service until the end of your current paid period. Refunds are handled exclusively by Apple or Google in accordance with their respective policies.

Free trials

• Standard Plan: 7-day free trial, beginning immediately upon signup. Automatically converts to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends.
• Dedicated Plan: 30-day free trial, beginning immediately upon signup. Automatically converts to a paid subscription at the end of the trial. Promotional credits toward your monthly bill may be available after conversion. Cancel through your device subscription settings at least 24 hours before the trial ends to avoid charges.

We accept the following payment methods through Apple App Store and Google Play:

• PayPal
• Apple Pay
• Google Pay
• Apple Account Balance
• Google Play Balance
• Mobile carrier billing (where available)

Refund policy

All goods and services are non-refundable. We do not offer partial refunds, pro-rated credits, or cash returns. All refund requests must be directed to Apple or Google through their standard refund processes.

Medical disclaimer

The exercises, routines, and databases provided through the Service are for general informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment.

Physical stretching and exercise involve inherent risks of injury. You should consult a qualified physician before beginning any new exercise program, particularly if you have pre-existing medical conditions, injuries, or health concerns.

By using the Service, you acknowledge these risks, agree to assume full responsibility for your participation, and release Decy Technologies Inc. from any liability arising from injury or harm.

Apple App Store and Google Play

Decy Technologies Inc. is solely responsible for the Reach Mobility app, including its content, maintenance, and support. Apple Inc. and Google LLC have no obligation to provide maintenance or technical support for the app.

Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you. Your use of the app is subject to the usage rules set out in the applicable App Store terms of service.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

Limitation of liability

To the maximum extent permitted by applicable law, Decy Technologies Inc. and its officers are not liable for any actions, claims, losses, damages, liabilities, expenses, or legal fees arising from your use of or inability to use the Service.

In no event will our total liability exceed the subscription fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages of any kind.

Indemnification

You agree to indemnify and hold harmless Decy Technologies Inc. and its officers from any claims, losses, damages, liabilities, expenses, and legal fees arising from your use of the Service or your violation of these Terms.

Dispute resolution

These Terms are governed by the laws of the Province of Alberta, Canada. The Consumer Protection Act applies where required by applicable law.

Any disputes arising from these Terms will be resolved through binding arbitration, except where prohibited by law. Nothing in this section limits your right to bring a claim in small claims court or to seek injunctive relief for intellectual property infringement.

Embargo and sanctions compliance

By using the Service, you represent that you are not located in a country subject to a Canadian or US government embargo, and that you are not on any Canadian or US government prohibited or restricted parties list.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be removed and the remaining Terms will continue in full force and effect.

Changes to these terms

We may update these Terms to comply with legal requirements or reflect changes to the Service. We will notify you of material changes by email (if you have provided one) or by posting a notice on the website. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
